1. Payment and Authorization:
- By making a purchase from The Cuevas Container Company, the customer agrees to provide valid payment information and authorize the transaction.
- Payment for shipping containers must be made in full prior to delivery, unless otherwise agreed upon in writing by both parties.
2. Delivery and Acceptance:
- Upon delivery of the shipping container, the customer or their authorized representative must inspect and sign a delivery receipt confirming receipt of the container in satisfactory condition.
- Delivery photographs may be taken as evidence of successful delivery and may be provided upon request.
3. Dispute Resolution:
- In the event of any dispute regarding the transaction, including but not limited to claims of fraud, the customer agrees to contact The Cuevas Container Company directly to attempt to resolve the issue in good faith before initiating any chargeback proceedings.
- The customer agrees to provide any necessary documentation or evidence requested by The Cuevas Container Company to resolve the dispute.
4. Chargebacks and Fraudulent Claims:
- The customer acknowledges that initiating a chargeback without first attempting to resolve the issue directly with The Cuevas Container Company constitutes a breach of these terms and conditions.
- The Cuevas Container Company reserves the right to dispute any chargeback initiated by the customer and to provide evidence of delivery and acceptance of the shipping container as necessary to support its position.
5. Legal Remedies:
- In the event of a chargeback or fraudulent claim, The Cuevas Container Company reserves the right to pursue all available legal remedies to recover the full amount owed, including but not limited to legal action and collection efforts.
- The customer agrees to be responsible for all costs and expenses incurred by The Cuevas Container Company in connection with any dispute, including but not limited to legal fees and collection costs.
6. Governing Law:
- These terms and conditions shall be governed by and construed in accordance with the laws of The State of Texas, without regard to its conflict of law principles.
7. Modification and Severability:
- The Cuevas Container Company reserves the right to modify these terms and conditions at any time, with or without prior notice, at its sole discretion.
- If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By making a purchase from The Cuevas Container Company, the customer acknowledges that they have read, understood, and agreed to these terms and conditions in their entirety.
